By accessing or using Monoduty ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Service Description
Monoduty is a cloud-based alerting and monitoring platform that provides:
- Incident management and alerting services
- On-call scheduling and escalation policies
- Integration with monitoring tools and services
- Notification delivery via multiple channels (email, SMS, phone calls)
- Reporting and analytics capabilities
The Service is provided on a subscription basis with various pricing tiers and features.
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibility
You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
3.3 Account Types
We offer different account types including individual, team, and enterprise accounts. Each account type has different features and limitations as described in our pricing plans.
4. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited activities include:
- Violating any applicable laws or regulations
- Transmitting malicious code, viruses, or harmful content
- Attempting to gain unauthorized access to our systems
- Interfering with or disrupting the Service or servers
- Using the Service to send spam or unsolicited communications
- Reverse engineering or attempting to extract source code
- Sharing account credentials with unauthorized parties
5. Privacy and Data
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service.

6. Payments and Billing
6.1 Subscription Fees
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specifically stated in these Terms.
6.2 Payment Methods
We accept major credit cards and other payment methods as displayed on our pricing page. You authorize us to charge your chosen payment method for all fees.
6.3 Fee Changes
We may change our fees at any time. For existing subscribers, fee changes will take effect at the next billing cycle after we provide at least 30 days' notice.
6.4 Overages and Limits
Usage beyond your plan limits may result in additional charges or service restrictions as outlined in your specific plan.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Monoduty and its licensors. The Service is protected by copyright, trademark, and other laws.
You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.
8. Service Availability
We strive to maintain high availability of our Service, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be announced in advance when possible.
We are not liable for any downtime, service interruptions, or data loss that may occur. Our Service Level Agreement (SLA) for paid plans is detailed in your subscription agreement.
9. Limitation of Liability
To the maximum extent permitted by law, Monoduty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Our total liability to you for any damages arising from or related to these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Termination
10.1 Termination by You
You may terminate your account at any time by following the cancellation process in your account settings or by contacting us directly.
10.2 Termination by Us
We may terminate or suspend your account immediately if you violate these Terms or for any other reason at our sole discretion.
10.3 Effect of Termination
Upon termination, your right to use the Service will cease. We may delete your data after a reasonable period following termination.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of İzmir, Turkey.
